Find Fayette County Civil Dockets

Need a Fayette County civil docket search? Start with the Clerk of the Circuit Court, since that office keeps the docket for most civil matters in Fayette County. Know two things before you look: which court heard the case, and what kind of claim it was. Magistrate Court, Circuit Court, and Family Court each keep their own records, even though people call them all civil. Search by party name or the exact case number, and the docket will list parties, filings, hearing dates, and judgments in order. One caution: a docket is an index, not the filing itself. For certified copies or older cases, go straight to the clerk.

Fayette Civil Search Categories

The type filter helps locate a lower-court claim. Civil is broad. Unlawful Detainer identifies a possession case, Foreign Judgment marks a judgment registered from elsewhere, and Detinue Action concerns personal property. Commercial Credit and Wrongful Occupation may also appear. Select the closest known type, but do not treat a portal label as a final statement of rights.

Inside a Fayette Civil Docket

A Fayette civil docket can show Case ID, location, style, filing date, claim type, trial type, amount, assigned judge, parties, and related cases. The event schedule records hearings. A separate table lists filing dates, codes, descriptions, and filers. Civil Judgments and disposition fields may state an outcome. No single field replaces the newest order.

Case IDCopy the exact Case ID; do not infer a format.
PartiesPlaintiff, defendant, counsel, and other roles.
ClaimType, amount, date, and trial type when populated.
EventsDate, time, room, location, judge, and reason closed.
JudgmentJudgment, dismissal, appeal, or status when entered.

Fayette Venue Threshold Conflict

Two official judiciary pages state different magistrate civil limits. The current Magistrate Courts overview says authority reaches $20,000. A jury FAQ says no more than $10,000 and describes circuit claims with another figure. The pages do not reconcile the conflict. It would be unsafe to choose a court from either number alone.

Verify before filing: Ask the Circuit Clerk or Magistrate Clerk which court has authority over the claim, counterclaim, and case type.

The search path remains reliable once venue is known. Search magistrate cases in MCRSearch and circuit cases in WVPASS. Authority can depend on the claim and statutory exceptions, not just a dollar amount.

Civil Case Types on the Docket

Fayette County civil dockets span several courts. Major civil, equity, extraordinary, and appealed matters belong in Circuit Court. Magistrate Court handles authorized claims and named categories in MCRSearch. Family Court handles domestic relations, with tighter limits on protected material. Municipal court is not a general civil forum merely because a dispute arose inside city limits.

  • General civil, contract, tort, and equity matters
  • Small claims and other authorized magistrate matters
  • Unlawful detainer, detinue, and wrongful occupation
  • Foreign judgment and commercial credit cases
  • Domestic relations on the separate Family Court path

Fayette Orders Beyond Events

A Notice of Hearing shows that a setting was made or served. It is not a ruling. Hearing Continued means the event moved, not that the claim ended. Hearing Held says the proceeding occurred, but the resulting order may arrive later. A judgment entry also does not prove collection or enforcement.

When MCR shows an event but not the paper, write down the Case ID, event date, code, and description. The Magistrate Clerk supplies lower-court documents because MCRSearch does not publish them. For circuit matters, note the WVPASS docket date and ask the Circuit Clerk for the named order. Request certification only when an authenticated copy is required.

Civil Docket Settings and Hearings

MCR's Case Event Schedule lists type, date and time, room, location, judge, and reason closed when populated. Read it with the entries. An old date can remain after a continuance. The current setting is the newest open event supported by the later notice or order.

For circuit or family matters, search WVPASS and confirm an unclear date with the assigned office. Fayette research found no universal daily docket PDF. The Fayette County court-date process explains how to compare settings and clerk confirmation. Save the Case ID and ask whether appearance is in person or remote.

Fayette Family Court Path

Family Court is a separate level in Fayette County's Fourteenth Family Court Circuit. A domestic-relations matter should not be treated as an ordinary contract case merely because it is civil. WVPASS is the public path for available family records, but protected family, child, adoption, and juvenile material can be restricted.

The state Fayette court directory identifies circuit, family, and magistrate offices.

Fayette Civil Docket Access Rules

West Virginia law and court rules support inspection and copying through the proper custodian. Online displays are informational. The public can use the clerk's counter during normal hours, call first, or send a specific written request with the case and document. MCRSearch provides free magistrate information but not filed papers.

Key rules:

West Virginia Code §51-4-2 supports inspection and clerk-supplied copies, subject to exceptions.

West Virginia FOIA provides a written request path to a custodian.

Trial Court Rules 10.03 and 10.04 address restricted files and public inspection.

Sealed records, protected family material, juvenile records, and personal identifiers may be withheld or redacted. When an online entry and clerk copy differ, rely on the clerk's current record.

Programs Are Not Civil Dockets

Fayette Family Treatment Court is a named program, but its public description is not a participant docket. Use the case portal and custodian for a record, subject to family access limits.
